Mediating Angel’s Commercial Liability Claim
In October 2020, Angel was a passenger traveling south on Sam Houston Boulevard in San Benito, Texas towards Woodford Street. At the same time, the driver of a commercial vehicle was stopped on Woodford Street at the eastbound entrance onto Sam Houston Boulevard.
At the eastbound entrance of that intersection, a stop sign alerts drivers to stop and yield the right-of-way to north and southbound traffic. Unfortunately, the commercial driver facing this red stop sign failed to yield the right-of-way to Angel’s vehicle. As a result, the driver crashed into Angel’s vehicle. The responding police officer attributed the commercial driver’s failure to yield the right-of-way as the collision’s sole contributing factor and cited the commercial driver accordingly.
An ambulance transported Angel from the collision to a nearby hospital. After his discharge, Angel underwent months of medical attention, including two epidural steroid injections, to help alleviate the pain caused by the commercial driver’s negligence.
Following the collision, Angel retained my law firm to help him recoup his unpaid medical expenses and recover damages for his injuries. My firm gathered Angel’s medical records and bills and sent them to the commercial carrier. As is often the case, though, the driver’s commercial liability carrier refused to settle Angel’s claims for a reasonable value. With Angel’s permission, my firm filed a lawsuit against the driver and his employer in August 2021. After receiving a copy of the lawsuit, the insurance company contacted my office, and we agreed to mediate. Thanks to mediator Gil Peralez, my office helped convince the insurance carrier to settle Angel’s commercial claim for almost twice the value of the initial settlement offer.
