Mediating Sonia’s Commercial Wreck Successfully

In March 2018, Sonia and her child were driving back to Harlingen from a trip to Corpus Christi. While passing through Kleberg County, she slowed down to turn right into a convenience store for a break. Unfortunately, the driver of a commercial vehicle—who was traveling too closely behind Sonia—failed to control his speed and crashed into her car. The force of the impact was strong enough to crush the trunk of Sonia’s car and render it a total loss. The state trooper who responded to the scene blamed the commercial driver for causing the collision and cited him for “Failure to Control Speed.” The driver later entered a plea and paid a fine.

An ambulance took Sonia and her child to a nearby hospital where both were seen and treated by the emergency medical personnel. Since Sonia continued to experience pain throughout her back after her discharge, she called my old office and asked for help. We referred her to medical practitioners with experience treating victims of motor-vehicle collisions so she could recover from her injuries. In the end, the commercial driver’s negligence caused Sonia to make two emergency room visits, receive multiple epidural steroid injections, and undergo two spinal surgeries.

Unlike most of the cases we have settled, Sonia’s case required that my old firm file a lawsuit on her behalf. While formal litigation could cause a case to drag on for months—and even years—after a wreck, my staff and I were able to push this case to mediation relatively quickly.
