Isaac’s Settlement After a Commercial Sideswipe

Last July, the driver of a commercial vehicle was approaching a hillcrest on I-10 in Houston, Texas and failed to notice that traffic was at a standstill. The driver attempted to brake, but he lost control of his rig, slid in-and-out of his lane, and sideswiped Isaac’s vehicle. The collision caused the rig to jackknife and sent Isaac into the dividing concrete barrier. After the impact, Issac immediately called 911, and a Houston P.D. officer arrived shortly after. Following an on-scene investigation, the officer blamed the commercial driver for causing the collision and cited him for failure to control speed and failure to maintain a single lane.

Isaac contacted my office immediately after the collision. Since he was experiencing pain, we arranged for him to meet with a medical doctor. Over the next few months, Isaac underwent physical therapy and received several injections to alleviate the pain in his shoulders, neck, and lower back. Isaac’s pain is so severe that an orthopedic surgeon believes he will need surgery for permanent relief.

The commercial driver and his insurance company accepted responsibility for the collision. However, the insurer’s valuation of Isaac’s case focused only on the medical bills; it refused to consider how the crash affected Isaac’s day-to-day life and well being.
