Jesus and Rachel’s Policy Limit Settlement
In April, Jesus and Rachel were driving south on Paso Real towards Business 77 in San Benito, Texas. At Paso Real and Business 77, alternating traffic signals direct vehicles to stop and proceed into the intersection. Before entering the intersection, Jesus and Rachel had a green light. Unfortunately, a second driver ran her red light and crashed into Jesus and Rachel’s vehicle.
Intersection cases can be tricky to resolve because both drivers often claim to have had the right-of-way. In this case, the responding police officer conducted an on-scene investigation to determine who ran the red light. Fortunately, the officer located two eyewitnesses who confirmed that the other driver had a red light. Based on the eyewitnesses’ narratives, the officer attributed the second driver’s disregarding the red traffic signal as the collision’s only contributing factor and issued her a citation.
