Mediating Andy and Lucia’s Liability Claim

In May 2019, Andy and Lucia were driving west on Nolana Avenue towards 16th Street in McAllen, Texas. A second driver was stopped on 16th Street at the southbound entrance into the same intersection. 

The second driver had a stop sign requiring her to yield the right-of-way to east and westbound traffic. Unfortunately, the driver attempted to cross Nolana even though Andy and Lucia were already very close to the intersection. As a result, the second driver crashed into Andy and Lucia’s vehicle, causing bodily injuries and property damage. At the scene, the responding officer cited the other driver for running the stop sign and failing to yield the right-of-way.

Following the crash, Andy and Lucia retained my office to help them recover their damages. For various reasons, the at-fault driver’s liability carrier refused to settle my clients’ claims for a fair value. With Andy and Lucia’s permission, my office filed a lawsuit against the at-fault driver in late 2020. During the next few months, my staff and I pushed this claim through the legal system by sending and completing written discovery and attending multiple depositions. Thanks to mediator Gil Peralez, my office successfully convinced the liability carrier to settle Andy and Lucia’s claim for almost twice the value of the initial settlement offers.
