Settling Daniel’s UM/UIM Lawsuit
In March 2020, Daniel was driving east on Boca Chica Boulevard in Brownsville towards Owens Road. A second driver was trying to turn left onto Owens Road from Boca Chica’s center-turning lane. Unfortunately, the second driver tried to turn when Daniel was already very close to the intersection and the other driver. As a result, the second driver caused Daniel to crash into the passenger side of the other driver’s vehicle. The responding police officer attributed 100% responsibility for the collision to the second driver’s failure to yield the right-of-way. Unfortunately, the officer also discovered that the at-fault driver did not have a valid liability auto insurance policy.
The force of the impact caused Daniel to experience pain throughout his back, neck, and shoulders. After the collision, Daniel underwent several weeks of medical care to help relieve the injuries and pain he sustained due to the collision. His treatment included imaging studies of the injured areas, several weeks of physical therapy, and multiple pain injections, including two epidural steroid injections.
Daniel was familiar with my law firm because my office had previously represented a family member in an auto accident. Several days after the collision, Daniel retained my firm as well. Although the at-fault driver did not have auto insurance, Daniel had a UM/UIM policy. After Daniel retained my law firm, we sent his UM/UIM carrier—a nationwide company that regularly runs television and radio commercials—a demand to recover the benefits under Daniel’s auto policy. While the UM/UIM carrier agreed that Daniel’s policy covered his injuries, the carrier’s proposed settlement ignored the physical pain Daniel suffered and did not consider all of his medical treatment.
Rather than negotiate further, my office filed an Irwin-type lawsuit directly against Daniel’s UM/UIM carrier. After filing the petition and serving the carrier, my office pushed Daniel’s case through the legal system. Five months later, the UM/UIM carrier’s lawyer contacted my office. The lawyer informed us that the newly assigned adjuster re-evaluated the claim and agreed to pay Daniel the maximum settlement possible under his UM/UIM policy without the need for further legal proceedings.
