Joshua’s Policy Limit Settlement

Last July, Joshua was driving south on F Street in Harlingen towards the intersection with Buchanan Street. A second driver was stopped on Buchanan Street at the westbound entrance into that intersection.

At the time of the accident, two stop signs directed all east and westbound traffic to yield the right-of-way to all north and southbound traffic. Unfortunately, the second driver disregarded the stop sign. As a result, she crashed into Joshua’s vehicle, causing significant property damage and personal injuries. At the scene, the responding police officer identified the second driver’s failure to yield the right-of-way as the collision’s only contributing factor and issued her a citation.

Immediately after the collision, Joshua went to a local urgent care facility, where he received imaging studies and several pain injections. After his discharge, Joshua underwent several weeks of physical therapy and ultimately required additional pain injections, including two epidural steroid injections, to help with the pain caused by the collision.

Joshua retained my firm soon after the collision, and my staff and I immediately began working on his claim. After gathering all the evidence necessary to prove that the at-fault driver’s negligence caused Joshua to incur unnecessary medical bills and endure needless pain, we sent a demand to the at-fault driver’s liability carrier. Several weeks later, the carrier agreed to tender its insured policy limits (i.e., the maximum available amount of compensation) to settle Joshua’s claim.
